1. Who you’re agreeing with
These terms govern your use of designedbyanthony.com and related properties operated by Designed by Anthony (“ANTHONY”, “we”, “us”), a sole proprietorship of Anthony Jones in Rome, NY, USA.
By using this site, you agree to these terms. If you don’t agree, don’t use the site.
2. What the site is
A marketing site for digital infrastructure services (custom websites, SEO retainers, edge hosting), a free website audit tool at /lighthouse, and access to a paid tools subscription at designedbyanthony.online.
3. Geographic scope
ANTHONY serves clients in the United States and Canada. Visitors from the EU, UK, EEA, and Switzerland are blocked at the Cloudflare edge.
4. Free audits
The audit at /lighthouse is provided as-is with no warranty. It runs Google Lighthouse against your URL, queries Google Places for your business profile, and asks Claude (Anthropic) to summarize findings. We do not guarantee:
- Accuracy of the scores (Lighthouse itself has known variance between runs)
- That implementing the recommendations will improve any business outcome
- Continuous availability of the audit endpoint
Use of the audit constitutes consent for ANTHONY to: scan the URL you submit, store the report against your email for 90 days, and email you a copy of the PDF.
5. Paid services and engagements
Use of this site does not create a client relationship until a written agreement is signed (via our electronic signing flow at /contract/... or a paper contract). All paid engagements are governed by that signed agreement, which controls in case of conflict with these terms.
Scope of work, payment milestones, deliverables, and revision limits are defined per signed engagement. Out-of-scope changes are billed at the rate stated in your engagement (typical: $150/hr) or via a written change order.
6. Payment
- One-time fees: due per the signed engagement. For one-time fees structured as 50/50 (e.g. the Fast Track plan), 50% is due on signing and the remaining 50% is due on your written sign-off of the live preview.
- Subscriptions (Hands-Off Plan, Local SEO): billed monthly via Stripe, no long-term commitment, cancellable any time with cancellation effective at the end of the current billing period.
- Refunds: For one-time fees structured as 50/50, the deposit is fully refundable in writing until you approve the initial design preview, at which point it becomes non-refundable. No refunds are issued for completed deliverables after live-preview sign-off. Subscriptions are pro-rated for unused days on cancellation only when cancellation is initiated by ANTHONY.
- Late payments: invoices not paid within 30 days accrue 1.5% monthly interest. Site access, ongoing support, and hosting may be suspended after 60 days past due.
7. Intellectual property
Deliverables: On full payment, you own the final deliverable code, design files, and content created specifically for your project. You may use, modify, and redistribute it without restriction.
ANTHONY retains: rights to non-client-specific code patterns, libraries, methodologies, and the right to display your project in our portfolio with screenshots and a high-level description (unless you opt out in writing within 30 days of project completion).
Third-party assets: any third-party fonts, stock images, or libraries used in your project remain under their original licenses (typically MIT, OFL, Unsplash License). We document these in a project license file.
Site content (this site): All content on designedbyanthony.com — copy, screenshots, design, code — is copyright Anthony Jones unless otherwise noted. You may not copy substantial portions for commercial use without written permission. Linking, quoting with attribution, and personal or educational reference are fine.
8. Acceptable use
Don’t use this site to:
- Scrape, mirror, or systematically harvest content (the audit endpoint is rate-limited at 30 requests per 60 seconds per IP)
- Submit URLs you don’t own or have permission to scan
- Send spam through any contact form
- Test the security of the site without prior written authorization (responsible disclosure to anthony@designedbyanthony.com is always welcome and never prosecuted)
- Impersonate ANTHONY or pretend to be a client
We may block IPs or accounts at our discretion to enforce this section.
9. Disclaimer of warranties
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- IN NO EVENT SHALL ANTHONY’S TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS EXCEED THE GREATER OF (A) THE FEES YOU PAID IN THE PRIOR 12 MONTHS, OR (B) USD $500.
- IN NO EVENT SHALL ANTHONY BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION — EVEN IF ADVISED OF THE POSSIBILITY.
Some jurisdictions do not allow these limitations; in those, they apply to the maximum extent permitted.
11. Indemnification
You agree to indemnify and hold ANTHONY harmless from any claim arising out of:
- Your use of the site in violation of these terms
- URLs you submitted for audit that you did not own or have permission to scan
- Content you provided for your project that infringes a third party’s rights
12. Flex Lease (3-pay) custom web design
For customers paying for a custom web design under our 3-pay “Flex Lease” plan, the following applies:
- Payment schedule. Three (3) monthly installments of $350 each. The first installment is due on the date you Approve the initial design preview.
- Go-live on Approve. Your site goes live on the date you Approve the design — regardless of whether the first payment has cleared. We won’t hold your launch hostage to a payment-processor timing issue.
- Source code release. The full source code is released to you after the third and final installment clears. Until then we host and manage it for you.
- Missed payment — soft grace. If a scheduled installment fails, you get a 3-day grace period with friendly reminder emails (no late fees). If the installment is still unpaid after the 3-day grace, the live site is temporarily paused — NOT terminated. Your data, design, and configuration remain intact.
- Restoration window. Any time within 30 days of the temporary pause, paying the past-due installment automatically restores your site to its pre-pause state with one click. After 30 days unpaid, the engagement may be cancelled at our discretion — at which point we’ll work with you in good faith on a payment plan or release of materials.
- Fully refundable. Until you Approve the initial design preview, the engagement is fully refundable, no questions asked.
13. Termination
We may suspend or terminate your access (free or paid) at any time for material breach of these terms. Paid subscriptions can be cancelled by either party with the notice defined in your signed engagement.
On termination of a paid engagement, we’ll provide you with a final copy of your deliverables and remove your data per the retention schedule in our Privacy Policy.
14. Changes to these terms
We may update these terms. Material changes are announced via the cookie banner and an email to active customers if affected. Continuing to use the site after a material change constitutes acceptance.
15. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Oneida County, NY. The prevailing party is entitled to reasonable attorneys’ fees.
16. Severability
If any part of these terms is held unenforceable, the rest remains in effect.
